US Suspends Microsoft From Green-Card Programme

The US government has moved against one of its biggest technology employers at the same moment it is celebrating its chief executive. On Thursday, Vice President JD Vance announced that Microsoft would be suspended from a programme used to seek employment-based green cards for foreign workers. He accused the company of using the system to replace American staff. Microsoft disputes the picture he presented, and the competing accounts turn this into more than a routine immigration-policy fight.

The suspension concerns the process that lets an employer seek permanent residency for a worker after showing that the role has been advertised to US workers. It should not be confused with a blanket ban on Microsoft employing people on H-1B visas. The Associated Press reports that Vance alleged Microsoft laid off about 6,000 US workers last year while obtaining 6,300 H-1B visas and nearly 3,000 green cards. The administration said other technology and consulting firms would also be suspended from the green-card programme.

Those figures make for a forceful political argument, but they do not by themselves show that laid-off workers were replaced one for one. Microsoft told AP that about 80 percent of its roughly 6,000 H-1B petitions in the last fiscal year were for extensions or changes to the status of existing employees. It said the remaining new-employee filings involved people already legally in the United States and amounted to about one percent of its US workforce. The company says it applies the required standards to its filings.

That distinction matters to the people caught in the middle. An H-1B is a temporary work visa; a green card gives a worker permanent residency and more freedom to change jobs. A former US immigration official quoted by AP argued that blocking a path to permanent status could leave workers more dependent on their employers, even if the government’s stated concern is their vulnerability. Critics of the H-1B system, meanwhile, say enforcement of protections for domestic workers has been too weak. Both questions deserve scrutiny without treating an allegation as a finding.

The timing is awkward for Washington. Hours after the announcement, President Donald Trump awarded Microsoft CEO Satya Nadella the National Medal of Technology and Innovation. The administration is urging American companies to lead in AI while challenging how some of those same companies recruit and retain specialist workers. Microsoft’s recent job cuts amid heavy AI spending have already sharpened questions about what that transition means for workers.

For technology companies, the practical consequences will depend on the scope and duration of the suspension, whether applications already in progress are affected, and what evidence the government releases to support its allegations. For engineers and researchers from outside the United States, the issue is more immediate. A route from a temporary visa to permanent status can shape where a family lives and whether a skilled worker decides to build a career in America at all.

There is a legitimate debate about fair hiring and immigration enforcement. But it requires separating H-1B petitions, green-card applications and layoffs before drawing conclusions from a headline number. Microsoft’s response makes that accounting central to the story, not a footnote to it.
